The Department has advised that an applicant with a provisional license/registration generally does not satisfy regs 186.211/187.211, where registration or licensing is mandatory for an occupation, policy intention is that full registration and licensing would be required for the purpose of meeting ENS/RSMS visa requirements.
Section 3.7.11.2. of the 186/187 visa Procedural Instruction states the condition when the requirements of regs 186.211/187.211 are satisfied and when not:
If for visa purposes, registration, licensing, or professional membership is mandatory, the registration, licensing, or professional membership held must not impose further requirements or limit the ability of the person to perform the full range of tasks and the person must not require further training or on-the-job supervision:
- an applicant with conditional or provisional registration, licensing, or professional membership that requires them to undergo additional safety or occupational training or to work in supervised workshops does not satisfy regs 186.211/187.211 but
- continuing professional development requirements of fully registered or licensed applicants are acceptable, however, and such applicants satisfy regs 186.211/187.211.
