Employer Sponsored Visas
1. Can my client’s visa be cancelled by his employer?
No. However, your client’s employer may contact the Department and request them
for cancellation your visa, depending on the type of visa they hold.
2. What is a labour agreement?
Labour agreement is a formal arrangement between an Australian organisation and
the Australian Government for allowing the organisation to recruit an agreed number
of skilled workers from outside Australia. Usually the labour agreement identifies the
relevant skills shortage in the business and why these vacancies cannot be filled by
Australian workers.
3.What will happen if my client’s employer (sponsor) ends his employment?
If your client’s employer ends his employment, he is given 90 days to either find
another employer to sponsor him or apply for a different visa or leave Australia within
90 days, or before the visa expires, whichever comes first.
4.What are paying for visa sponsorship scams?
In 2015, new criminal and civil penalties and visa cancellation provisions were
introduced as part of visa sponsorship framework which provided for imposition of
sanctions on a person who asks for, receives, offers or provides a benefit in return for
visa sponsorship or employment.
